VISTA DUI CRIMINAL PROCESS

There are two separate procedures that are initiated following an arrest for a Vista DUI.  The APS hearing is held through the DMV and will determine the length of time that your license is suspended based on violation of vehicle code 23152 (b) driving with a BAC of over .08%.  The second process is through the San Diego County Criminal Courts.  When you are arrested for a Vista DUI you will receive a citation that lists the crimes you are being charged with by the officer and at the bottom will list your first court date known as your arraignment.  The citation will include the courthouse, date and time of your first court date following an arrest for a Vista DUI

Arraignment following a Vista DUI

Attendance at the arraignment is required following a Vista DUI if you have not hired a competent Vista DUI attorney.  A Vista DUI criminal defense lawyer will be able to appear for you at the arraignment and enter your plea of guilty or not guilty to the charges.  You have the right to request discovery on your Vista DUI case.  Discovery will include the police report taken during your Vista DUI arrest.  At this point the court will set a date for pre-trial or you may be able to continue the arraignment if discovery in your Vista DUI case is not available.

Pre-trial following a Vista DUI arrest

At the conclusion of a Vista DUI arraignment if you enter “not guilty,” a pre-trial date will be set.  This date will allow you or your representative to enter motions on your behalf.  A qualified Vista DUI-DWI attorney will be able to enter into negotiations with the Vista District Attorney to try to achieve the best possible outcome in your case.  If you decide not to hire a competent Vista DUI lawyer to represent you at your court appearances you may miss out on valuable opportunities to work with the Vista District Attorney to find a reasonable outcome and may be stuck with the maximum punishment.

Trial following a Vista DUI-DWI arrest

If negotiations come to a stand-still with the Vista District Attorney and no equitable compromise can be reached you or your Vista DUI attorney may decide that a jury trial is the best way to achieve a positive outcome.  A jury trial following a Vista Arrest for DUI will begin with jury selection.  The jury will consist of 12 women and/or men selected from a pool of county citizens.  The prosecution and defense will present their individual cases including evidence and motions pertaining to the Vista DUI arrest.  Eventually, the case will be given to the jury to determine the guilt or innocence of the Vista DUI suspect.  Following a guilty verdict the judge will determine the penalties the convicted Vista DUI-DWI offender must serve.  The judge will take recommendations from the Vista District Attorney and will consider the character of the defendant.
